Derry - 10th Circuit District Court

The New Hampshire 10th Circuit – District Division – Derry Court, commonly known as the Derry District Court, handles misdemeanor and violation cases brought by the following town: Derry, Londonderry, Chester and Sandown. This is a very busy Court, often a packed courtroom, filled mostly with people charged out of Derry.

All local violations and misdemeanors go through this Court, including:

  • DWI / DUI
  • Simple Assault
  • Domestic Violence
  • Theft and Shoplifting
  • Driving after Suspension and other driving offenses
  • Possession of Marijuana

When charged as a Class A misdemeanors, such crimes carry penalties of up to one year in the house of correction and/or a $2,000 fine. Even when the charge is not a Class A Misdemeanor, severe consequences may be imposed such as fines, “no contact” orders, loss of driver’s license, and court ordered treatment or programming (which can be very expensive).

Felony cases may also start in Derry District Court when the case begins with an arrest rather than an indictment. This early stage may be critical in a felony case. Bail is set by the court, determining whether the accused remains free or in jail awaiting trial. There is also a “probable cause” hearing at which the prosecution must present at least some of the evidence which supports the charge. The outcome of either of these proceedings may have a significant impact on the accused and how the case proceeds when it later goes to the Rockingham County Superior Court. Finally, and most importantly, when a felony starts in district court, there is sometimes a chance to resolve the case as a misdemeanor in the district court before there is an indictment and the case hits the docket in superior court. Sometimes this is the best chance to avoid a felony conviction.

The Derry Police prosecute the majority of cases brought in this Court, with an attorney prosecutor from the Rockingham County Attorney's Office handling the case from arraignment (first appearance) to trial. The other towns represented in this Court have their own prosecutors. A separate prosecuting attorney works for the State Police and prosecutes some of their cases, including DWI cases, in the Derry District Court. State Police tend to make arrests on Route 93, which runs right through Londonderry and Derry.
