On this page, we highlight a few client testimonials but also will point out: You can read many more testimonials, and client reviews, on www.Avvo.com for Richard Guerriero here and Ted Lothstein here. In all instances on such sites, and on this page, the client wrote the testimonial or review in his or her own words without any editing on our part.

The following testimonial was posted by an appeal client on several platforms, including Google Reviews and Avvo. The testimonial is reproduced here with the client's permission. We have not changed a single word. On the "Victories on Appeal" page, you can read more about this remarkable case.

Back in 2019 I was falsely accused of committing a crime. The subsequent police investigations resulted in my arrest and eventually a wrongful conviction. The criminal attorney who represented me throughout the ordeal highly recommended attorney Lothstein and his law firm to do the appeal.

The trial transcripts and all of the other required documentation were gathered and submitted, and Lothstein and Guerriero went to work. The case was accepted by the NH Supreme Court, and oral arguments were heard in the fall of 2022. I was able to attend the oral arguments, and watching attorney Lothstein in action was an absolute privilege. Attorney Lothstein had previously explained the percentages of successful appeals to me, but I left the oral arguments feeling very, very, hopeful.

On March 30, 2023, I received word that the conviction was reversed and remanded back to the Superior Court where the trial was conducted. The opinion that the Supreme Court issued was a very strong, concise, and unanimous decision. It is a decision that will be cited in motions and briefs far into the future, and will hopefully help prevent future wrongful convictions due to the law created in our case.

It also gave the State of New Hampshire really no choice on their next action, as evidenced by the verbiage on the Notice of Nolle Prosequi that we received from the Superior Court: “Given Supreme Court Order of reverse and remand, the State is not pursuing this charge.”

These results were not achieved by accident. The dedication given to this case by attorney Lothstein and his entire legal staff was incredible. From day one I was treated as a person as opposed to just a client. The level of comfort that I felt from the first day we spoke was as high as it could have possibly been, and it remained that way until the day the ruling was announced. The victory that we celebrated in the following days was an extremely hard, well fought, and justly deserved one that has been instrumental in helping me “recover” from a nightmare that continued for only several weeks shy of four very long years.

If anyone reading this review has any doubt about who I would recommend to someone in need of an appellate attorney (or any other practice areas they specialize in), you should try reading this review again from the beginning. I know I have said it many times, but once again- attorney Lothstein, Melanie, and everyone else- Thank you again for all that you have done. - D.T.

"Ted Lothstein and Melanie were extremely professional, very effective and beyond pleasant to work with. The office and staff were very easy to work with on a complex issue I was facing, and I couldn't be more pleased with the representation I received."

- Michael Harris (legal matter in Merrimack County Superior Court, Mr. Harris provided consent to use his name)

"I consulted with and was told by 2 different lawyers that I had no case and that a DWI conviction was GUARANTEED . I then spoke with Mr. Lothstein and hired his services on the spot. His exceptional knowledge on DWI law and police procedure was evident immediately. In the end Mr. Lothstein got the DWI charges dropped and I pled guilty to a reckless driving. Best phone call I ever made."

  • Benjamin, Testimonial provided 1/31/2018, Case in Seabrook District Court, Seabrook NH

I was stopped in a roadblock when coming home from a night out with my wife. I refused a breath test, and I was charged with DWI in the Laconia District Court. I have a CDL (commercial driver’s license), and depend on it for my livelihood, as a building contractor. I knew that if I lost my license because of the refusal of the breath test, or because of a DWI conviction, I would lose my CDL for a whole year, which would destroy my business, and would be devastating to my family.

I hired Ted Lothstein to defend me, and he did a great job. He got me out of the refusal suspension, and got me out of the DWI – this saved my CDL. Instead, I was only convicted of reckless operation, which is a traffic violation; I lost my regular driver’s license for 90 days, but did not lose my CDL. I would urge any person charged with DWI in NH, to speak with Ted Lothstein before they make the decision who to hire as their lawyer.

I was charged in the Keene District Court with driving under the influence, Speeding, and a lane violation – crossing the center line. I had refused the breath test. I hired Richard Guerriero. He was very “realistic” with me. No promises or false hope, just the truth, which I appreciated.

Richard was very prompt in getting me the police report, my hearing, and everything else needed to win my hearing for my ALS, forcing the State to offer a plea bargain. He got me a plea bargain where the DUI was dropped and I was convicted only of minor traffic offenses, speeding and the lane violation!

In March of 2014 my life was about to change forever. I had been charged with a Class A Felony for embezzlement. I was scared, devastated and did not know where to turn. I was highly recommended to Attorney Theodore Lothstein by another lawyer who did not have the ability to take on my case. I am so glad that I followed up on that lead and called him. His professionalism, compassion and understanding went well beyond what I could ever hope for. From the very first meeting, he fully explained each step of the process of the case and he answered all my many questions and concerns.

The stress of not knowing what your future holds is overwhelming, however, both Attorney Lothstein and his staff not only treated me with respect, but they followed up on my numerous requests and kept me and my family informed throughout the entire process. They managed to make a very stressful period in our lives more bearable.

I was facing 7-1/2 to 15 years in prison for my crime and Attorney Lothstein worked tirelessly on my defense and he managed to get my sentence reduced to a cap plea of 90 days in jail to be served on weekends. Without his expertise, impressive skills and his knowledge of case law, I would not be able to hold onto my job, take care of my family or have the ability to continue paying off my restitution. I would highly recommend Attorney Lothstein to anyone in need of a highly skilled professional defense attorney.

When our son was arrested for a serious crime, Richard Guerriero was recommended to us by two independent sources. At the initial consultation we knew immediately that he was the right person to defend our son. As well as being an experienced and skilled attorney, we found him to be straightforward, ethical, responsive, and caring. We were also pleased that he was upfront and fair about his fees.

Even though it was a first offense and our son had never been in trouble with the law before, the nature of the charges could have resulted in a very lengthy prison sentence. Attorney Guerriero worked diligently with the prosecutor to get the amount of time reduced to below the statutory minimum. While we were at times impatient with the process and delay in getting information, we soon realized that Attorney Guerriero was true to his word to take things one step at a time and keep us informed as soon as he could. He is conservative and cautious about expectations, never promising more than he can deliver. However, in our son’s case, he delivered more than we could have expected or hoped for.

Attorney Ted Lothstein represented my daughter in Hillsborough County Superior Court-North in April 2016. She was facing three assault charges. Ted worked very hard and was well prepared for the case. He was tough and aggressive but always managed stay calm and respectful. He did his job well without alienating the judge or members of the jury. It was a complicated and confusing case, but Ted manage to get the jury to understand the facts. If convicted of any of the charges my daughter was facing large fines and possible jail time. The jury deliberated less than an hour before returning a unanimous not guilty verdict on all three charges. If any of my family or friends ever need legal representation I would definitely recommend they retain Ted.

My son was arrested for DUI in NH. He was underage and refused the breathalyzer and field sobriety tests. We are from out of state and knew he needed a lawyer but didn’t know who to turn to. We are grateful that we found Attorney Ted Lothstein. As soon as we contacted him, he responded promptly and explained the situation and all of my son’s options. He made the process easy for us with clear explanations, instructions and honest expectations. Being located out of state was a concern but we were easily able to conduct business through phone, text messages, email and my son was able to appear at his hearing via web cam so he didn’t miss any of his college classes. Most importantly, Attorney Lothstein did an excellent job preparing and presenting the case in court with the optimal result of a not guilty verdict! My son and I are greatly relieved that his arrest record will be annulled and are very appreciative of Attorney Lothstein’s hard work and expertise.

  • Note from Attorney Lothstein: This testimonial is exactly as sent by client's mother, unedited. The trial occurred in May, 2016 in the Keene Circuit Court. The Keene Police Department charged this young client with DWI, and after trial, Judge Burke found the defendant not guilty.
Dear Ted,
I can’t thank you enough for your help in having a favorable outcome. I am not sure what you and Mr. [Prosecutor] discussed but I know that what ever it was, was to my advantage. You have been so supportive in this whole ordeal and now I can finally step back, take a deep breathe and go on with my life. The past few months have been stressful to say the least. You’re an excellent lawyer and person. Hopefully our paths will not cross again on a criminal issue. I would definitely recommend you to anyone. Your professional attitude was what made me hire you for my case. Please thank Emily for me for all the times she answered my questions and concerns as well. You definitely have a wonderful practice. The world needs more caring people like you in the justice system.
Note from Attorney Lothstein: this Client was charged by the Belmont Police Department with Reckless Operation in the Laconia District Court. If convicted, she would have lost her license for 60 days. Instead, in March, 2016, she pled to a minor motor vehicle violation, paid a $124 fine, and did not lose her license at all. As always, all testimonials are displayed with the client's express consent and are reproduced as received, never edited for content.

"As a prior client of Ted Lothstein, PLLC Concord, NH., that both Ted Lothstein and I believe we both regard as a very successful outcome to my case.

Before I hired Ted Lothstein I did research on several Attorneys representing criminal cases and I found Ted Lothstein as the best and most successful for representation and case outcome.

My arrest and how I was handled from the beginning certainly was not how I should have been dealt with. There were many aspects of this case surrounding facts, hospital records and a Trooper witness and Prosecutor that saw this case from Ted Lothstein's professional expertise.

The surrounding facts that my husband and myself were in an alcohol related incidence. Not a criminal act, however; self defense, further, That a whiteness falsely stated this incidence as being that I was the aggressor that persuaded my arrest as the officer saw this as facts.

I was frightened beyond belief about the thought of possibly going to prison for five to seven years and just the thoughts of this was overwhelming. In fact, I was unable to be in my home. I was in a detrimental situation of not only becoming homeless but loosing my car and my future.

Ted Lothstein's precision in law is outstanding! He dissects facts clearly and precisely states all the facts so there is no question about the case and the successful outcome. I highly recommend Ted Lothstein as your Attorney."

Note from Attorney Lothstein: This testimonial is exactly as sent by the client. The felony assault charges were brought against the client in January, 2017 in the Merrimack Superior Court. The NH State Police charged this client with Second Degree Assault-a Class B Felony, and after further investigation by Attorney Lothstein and discussions with the prosecutor, the State dismissed the charges against the client, resulting in no conviction.
