The following testimonial was posted by an appeal client on several platforms, including Google Reviews and Avvo. The testimonial is reproduced here with the client's permission. We have not changed a single word. On the "Victories on Appeal" page, you can read more about this remarkable case.
Back in 2019 I was falsely accused of committing a crime. The subsequent police investigations resulted in my arrest and eventually a wrongful conviction. The criminal attorney who represented me throughout the ordeal highly recommended attorney Lothstein and his law firm to do the appeal.
The trial transcripts and all of the other required documentation were gathered and submitted, and Lothstein and Guerriero went to work. The case was accepted by the NH Supreme Court, and oral arguments were heard in the fall of 2022. I was able to attend the oral arguments, and watching attorney Lothstein in action was an absolute privilege. Attorney Lothstein had previously explained the percentages of successful appeals to me, but I left the oral arguments feeling very, very, hopeful.
On March 30, 2023, I received word that the conviction was reversed and remanded back to the Superior Court where the trial was conducted. The opinion that the Supreme Court issued was a very strong, concise, and unanimous decision. It is a decision that will be cited in motions and briefs far into the future, and will hopefully help prevent future wrongful convictions due to the law created in our case.
It also gave the State of New Hampshire really no choice on their next action, as evidenced by the verbiage on the Notice of Nolle Prosequi that we received from the Superior Court: “Given Supreme Court Order of reverse and remand, the State is not pursuing this charge.”
These results were not achieved by accident. The dedication given to this case by attorney Lothstein and his entire legal staff was incredible. From day one I was treated as a person as opposed to just a client. The level of comfort that I felt from the first day we spoke was as high as it could have possibly been, and it remained that way until the day the ruling was announced. The victory that we celebrated in the following days was an extremely hard, well fought, and justly deserved one that has been instrumental in helping me “recover” from a nightmare that continued for only several weeks shy of four very long years.

I was stopped in a roadblock when coming home from a night out with my wife. I refused a breath test, and I was charged with DWI in the Laconia District Court. I have a CDL (commercial driver’s license), and depend on it for my livelihood, as a building contractor. I knew that if I lost my license because of the refusal of the breath test, or because of a DWI conviction, I would lose my CDL for a whole year, which would destroy my business, and would be devastating to my family.
I hired Ted Lothstein to defend me, and he did a great job. He got me out of the refusal suspension, and got me out of the DWI – this saved my CDL. Instead, I was only convicted of reckless operation, which is a traffic violation; I lost my regular driver’s license for 90 days, but did not lose my CDL. I would urge any person charged with DWI in NH, to speak with Ted Lothstein before they make the decision who to hire as their lawyer.

I was charged in the Keene District Court with driving under the influence, Speeding, and a lane violation – crossing the center line. I had refused the breath test. I hired Richard Guerriero. He was very “realistic” with me. No promises or false hope, just the truth, which I appreciated.

In March of 2014 my life was about to change forever. I had been charged with a Class A Felony for embezzlement. I was scared, devastated and did not know where to turn. When our son was arrested for a serious crime, Richard Guerriero was recommended to us by two independent sources. At the initial consultation we knew immediately that he was the right person to defend our son. As well as being an experienced and skilled attorney, we found him to be straightforward, ethical, responsive, and caring. We were also pleased that he was upfront and fair about his fees.
Even though it was a first offense and our son had never been in trouble with the law before, the nature of the charges could have resulted in a very lengthy prison sentence. Attorney Ted Lothstein represented my daughter in Hillsborough County Superior Court-North in April 2016. She was facing three assault charges. Ted worked very hard and was well prepared for the case. He was tough and aggressive but always managed stay calm and respectful. He did his job well without alienating the judge or members of the jury. It was a complicated and confusing case, but Ted manage to get the jury to understand the facts. If convicted of any of the charges my daughter was facing large fines and possible jail time.The jury deliberated less than an hour before returning a unanimous not guilty verdict on all three charges.
