Ted Lothstein Wins Not Guilty Verdicts
We are thrilled to report that on Wednesday, April 13, 2016, as published in this morning's Monadnock Ledger newspaper, Jess Burt was found not guilty by jury of all charges pending against her.
Background of Case
The charges arose out of false allegations that Jess Burt had assaulted a child while working at the Crotched Mountain School in Greenfield, New Hampshire. The State filed five counts of Simple Assault and on count of Violation of Privacy in the Hillsborough County Superior Court-North in Manchester, New Hampshire. On the morning of jury selection, the State dismissed the Violation of Privacy charge, because there was no evidence that Jess Burt had violated anyone's privacy, and also dismissed two of the counts of Simple Assault. The State brought the remaining three charges to jury trial. Jess Burt was defended by criminal defense lawyer Ted Lothstein of Lothstein Guerriero, PLLC in Concord, NH.
The Jury Trial
After a three day jury trial, a trial in which the government called just three witnesses and Jess Burt called four witnesses in her own defense, the jury found Jess innocent of all charges. The jury delivered justice swiftly and decisively, deliberating for less than an hour. Jess Burt, who had waited almost two years for justice in this case, was relieved and gratified by the jury's verdict.
