"Not guilty" was the best thing I heard in a year and a half. I was originally charged with Manslaughter, then charged with an "alternative" charge of Negligent Homicide. This all started with a horrible accident with a death resulting. I sought the advice of two friends who had been involved in the NH legal system for many years. They recommended Richard Guerriero for a very serious criminal case. I met with Richard on a Sunday and could clearly see that he was a person of integrity. I thankfully retained his services. Richard worked long and hard to get what prosecution thought was good key evidence thrown out. He found an expert witness who refuted the validity of that evidence. Richard filed several long motions objecting to the evidence. After a two-day hearing, before the trial, the judge threw that evidence out of the case. This is what led to the prosecution dropping the manslaughter charge just before the start of the trial. We went to trial on the negligent homicide charge. Richard and his law partner, Ted, were completely prepared for trial and fought for me all the way. After three days of trial, the jury quickly returned a not guilty verdict. When our son was arrested for a serious crime, Richard Guerriero was recommended to us by two independent sources. At the initial consultation we knew immediately that he was the right person to defend our son. As well as being an experienced and skilled attorney, we found him to be straightforward, ethical, responsive, and caring. We were also pleased that he was upfront and fair about his fees. In April of 2014 my 19 year old daughter received a violation for Possession of Alcohol by a minor. Back in 2019 I was falsely accused of committing a crime. The subsequent police investigations resulted in my arrest and eventually a wrongful conviction. The criminal attorney who represented me throughout the ordeal highly recommended attorney Lothstein and his law firm to do the appeal. The trial transcripts and all of the other required documentation were gathered and submitted, and Lothstein and Guerriero went to work. The case was accepted by the NH Supreme Court, and oral arguments were heard in the fall of 2022. I was able to attend the oral arguments, and watching attorney Lothstein in action was an absolute privilege. Attorney Lothstein had previously explained the percentages of successful appeals to me, but I left the oral arguments feeling very, very, hopeful. On March 30, 2023, I received word that the conviction was reversed and remanded back to the Superior Court where the trial was conducted. The opinion that the Supreme Court issued was a very strong, concise, and unanimous decision. It is a decision that will be cited in motions and briefs far into the future, and will hopefully help prevent future wrongful convictions due to the law created in our case. It also gave the State of New Hampshire really no choice on their next action, as evidenced by the verbiage on the Notice of Nolle Prosequi that we received from the Superior Court: “Given Supreme Court Order of reverse and remand, the State is not pursuing this charge.” These results were not achieved by accident. The dedication given to this case by attorney Lothstein and his entire legal staff was incredible. From day one I was treated as a person as opposed to just a client. The level of comfort that I felt from the first day we spoke was as high as it could have possibly been, and it remained that way until the day the ruling was announced. The victory that we celebrated in the following days was an extremely hard, well fought, and justly deserved one that has been instrumental in helping me “recover” from a nightmare that continued for only several weeks shy of four very long years. If anyone reading this review has any doubt about who I would recommend to someone in need of an appellate attorney (or any other practice areas they specialize in), you should try reading this review again from the beginning. I obviously met Ted under very embarrassing circumstances. I was arrested around Christmas for a DUI in Bedford and ended up having a breathalyzer that tested at .15. Right away I called several lawyers just hoping someone would tell me I had a case. Before I even received my police report, I had lawyers asking me to come in, talk to them, they felt confident in defending me. Which every phone call sounded like a salesmen. After a week or so, I had calmed down and had done some research online and found Lothstein Guerriero. I made my decision on their reviews and the fact that they commented on responses. I have just gone through a challenging time following a traumatizing, tragic auto/motorcycle accident that led to 14 months of legal proceedings, culminating in a trial at Concord District Court in October 2024. I was charged with vehicular assault as a Class A misdemeanor, which could have resulted in a year in jail, significant fines, and more. October 22, 2022 was the day I made the biggest mistake of my life! I was arrested for a DUI by NH State Police. A few days went by and I now had to face the reality of what was to come next.
